1. Introduction and Acceptance of Terms
By accessing the Avila Solar website or engaging our services, you agree to be bound by these Terms and Conditions of Use, applicable laws, and regulations. If you disagree with any of the stated terms and conditions, you are prohibited from using this site or our services.
2. Pricing, Business Hours, and Turnaround
2.1 Pricing and Fees
Pricing, terms, and conditions are subject to change without notice. Avila Solar revises and increases prices annually by approximately 3%.
2.2 Business Hours
Our standard business hours are Monday to Friday from 8:00 AM to 5:00 PM Pacific Standard Time (PST). We observe major national and federal holidays.
- For the purpose of these terms, one (1) business day is defined as eight (8) business hours.
2.3 Project Turnaround
- Residential: Standard turnaround is 24 business hours.
- Commercial: Turnaround times vary per project scope.
3. Payment Terms and Invoicing
3.1 Deposit and Billing
- Upfront Deposit: We require a 50% upfront payment for all residential and commercial projects.
- Final Payment: After the design is complete, the client will be invoiced for the services provided. It is our strict policy that we must receive payment of any remaining balance prior to releasing the final deliverables, unless a specific payment plan has been arranged with Avila Solar.
3.2 Approval Window
After submission of the deliverables, the client has three (3) days to approve the work and/or request changes.
3.3 Payment Methods
Checks may be made payable to Avila Solar. We also accept payments via PayPal or credit card through our online platform.
3.4 Late Fees and Payment Plans
If a payment plan is arranged:
- The client has 15 business days to submit payment after the invoice is submitted.
- A 10% late fee will be applied if payment is not received within 15 days.

4. Scope of Work and Revisions
4.1 Included Revisions
Commercial and Residential changes required due to Authority Having Jurisdiction (AHJ) and utility comments are included in the initial design fee.
4.2 Billable Revisions (Additional Services)
The following changes are considered additional services and will be invoiced separately. These may be billed at up to 50% of the original design fee, depending on the scope of the re-work:
- Module changes due to availability.
- Major layout changes.
- Inverter changes.
4.3 Aged Projects
Projects that are more than six (6) months old that require changes will be billed separately.
5. Liability and Disclaimers
5.1 Service Liability (Solar Installations)
All solar electric installations have an inherent risk to persons and property. The documents provided by this service hold no inherent value or liability, real or implied.
- Responsibility: Safety to people and property and all system liabilities are ultimately the responsibility of the contracted installing party.
- Recommendation: To further limit liability to the installing party, it is recommended to have a professional engineer, licensed in the jurisdiction of the system installation, review the system designs prior to installation and commissioning.
- Indemnification: Avila Solar and its design team assume no responsibility for, and shall not be liable for, any and all claims, losses, costs, damage, or injury whatsoever arising out of or in any way related to the system design, real or implied, from any cause or causes, including but not limited to negligence, professional errors or omissions, strict liability, or breach of contract or warranty (expressed or implied).
5.2 Website Disclaimer
The materials on Avila Solar’s site are provided “as is”. Avila Solar makes no guarantees, communicated or suggested, and hereby renounces and nullifies all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Avila Solar does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet site or otherwise relating to such materials or on any sites linked to this site.
5.3 Limitations
In no event shall Avila Solar or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Avila Solar’s Internet site, even if Avila Solar or an authorized representative has been notified orally or in writing of the possibility of such damage.
6. Website Use License

The materials appearing on Avila Solar’s website could include typographical, technical, or photographic errors. However, Avila Solar does not make any commitment to update the materials.
